1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Paperless Plans ("Company", "we", "us", or "our"), concerning your access to and use of our Gym Management SaaS application, website, and related services (collectively, the "Services").

By accessing the Services, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Services and you must discontinue use immediately.

2. Use of Services

Our services are designed to help fitness facility owners and gym administrators manage their business operations. You agree to use the services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Services.

• You are responsible for maintaining the confidentiality of your account credentials.
• You must not use the system to distribute spam, malware, or illicit content.
• You ensure that any member data you upload and process through our system complies with applicable local data protection laws.

3. Subscriptions and Payments

Access to certain premium features of the Services requires a paid subscription ("Plan").

• Billing: Subscriptions are billed in advance on a recurring basis (e.g., quarterly, semi-annually, annually) depending on the Plan you select.
• Payment Gateway: All payments are processed securely through Razorpay. We do not store your direct credit card details on our servers.
• Taxes: All fees are exclusive of applicable taxes unless stated otherwise.

4. Intellectual Property Rights

Unless otherwise indicated, the Services are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us.

5. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services, even if we have been advised of the possibility of such damages.
